Iscrizione al SSN  -  cittadini stranieri - domanda di conversione del permesso di soggiorno – rifiuto di iscrizione obbligatoria fino al rilascio del nuovo permesso  – art. 5, comma 9-bis e art. 34, comma 1, d.lgs. 286/1998 – necessaria identità di regime tra fase di rinnovo e fase di conversione - illegittimità del rifiuto di iscrizione – discriminazione – sussistenza 

In tema di iscrizione dei cittadini stranieri al SSN, l’art. 34, comma 1, lettera b), d.lgs.286/1998, laddove, ai fini del mantenimento di detta iscrizione dopo la scadenza del permesso di soggiorno, fa riferimento alla sola ipotesi di domanda di rinnovo del permesso e non all’ipotesi di conversione, deve essere letto in coordinamento con l’art. 5, comma 9-bis dello stesso d.lgs. che, invece, garantisce il mantenimento dei diritti derivanti dalla regolarità del soggiorno anche in caso di conversione, a nulla rilevando che quest’ultima, diversamente dal rinnovo, richieda un riesame dei requisiti. Allo stesso modo, non sorgono dubbi laddove lo straniero che richieda la conversione abbia comunque un rapporto di lavoro in corso e rientri pertanto nell’ipotesi di cui al comma 1, lettera a) art. 34 cit. Conseguentemente il comportamento di ASST Brescia e di Regione Lombardia che, in ipotesi di domanda di conversione, negano allo straniero l’iscrizione obbligatoria al SSN sino al rilascio del nuovo permesso è in contrasto con dette norme e costituisce una discriminazione in ragione della nazionalità, la quale deve essere rimossa ordinando all’ASST di consentire detta iscrizione.

In matters concerning the registration of foreign nationals with the National Health Service (SSN), Article 34(1)(b) of Legislative Decree No. 286/1998, insofar as, for the purposes of maintaining such registration after the expiry of a residence permit, it refers solely to an application for renewal of the permit and not to an application for its conversion, must be read in conjunction with Article 5(9-bis) of the same Legislative Decree, which guarantees the continuation of the rights arising from lawful residence also in cases of conversion, irrespective of the fact that, unlike renewal, conversion requires a reassessment of the relevant requirements. In any event, there is no room for doubt where the foreign national applying for conversion is in an ongoing employment relationship and therefore falls within the scope of Article 34(1)(a). Accordingly, the conduct of ASST Brescia and the Lombardy Region in refusing, in cases where an application for conversion has been made, to register the foreign national compulsorily with the SSN until the new residence permit is issued is contrary to those provisions and constitutes discrimination on grounds of nationality. Such discrimination must be remedied by ordering ASST Brescia to allow the applicant to register with the SSN.
