Discriminazione del caregiver – lavoratrice con figlio minore con disabilità grave – rifiuto datoriale di assegnazione stabile al solo turno mattutino – assegnazione della medesima turnazione prevista per gli altri lavoratori – violazione dell’obbligo di accomodamenti ragionevoli – discriminazione indiretta – sussistenza 

Costituisce discriminazione indiretta ai sensi dell\'art. 2, comma 1, lett. b), d. lgs. 216/2003 — secondo i principi enunciati da CGUE 11/9/2025, C-38/24, e da Cass., sez. lav., 10/4/2026, n. 9104 — la condotta del datore di lavoro che rifiuti di assegnare stabilmente al turno mattutino una lavoratrice part-time, madre e caregiver di figlio minore con grave disabilità ex art. 3, comma 3, l. 104/1992, imponendo alla stessa il medesimo regime di turnazione riservato al restante personale, senza considerazione della sua peculiare condizione. Tale assegnazione è infatti doverosa in quanto costituisce  accomodamento ragionevole di natura organizzativa idoneo a consentire alla lavoratrice l\'assolvimento degli obblighi di assistenza, che il datore di lavoro è tenuto ad adottare, ai sensi dell\'art. 3, comma 3-bis, d. lgs. 216/2003 e dell\'art. 5 della direttiva 2000/78/CE.

It constitutes indirect discrimination within the meaning of Article 2(1)(b) of Legislative Decree No. 216/2003 — in accordance with the principles set out in CJEU judgment of 11 September 2025, Case C-38/24, and Court of Cassation, Labour Section, judgment of 10 April 2026, No. 9104 — for an employer to refuse to grant a fixed assignment to the morning shift to a part-time employee who is the mother and caregiver of a minor child with a severe disability within the meaning of Article 3(3) of Law No. 104/1992, thereby subjecting her to the same shift rotation applied to the rest of the staff, without regard to her particular situation. Such an assignment is in fact required, as it constitutes a reasonable accommodation of an organisational nature suitable for enabling the employee to fulfil her caregiving obligations, which the employer is required to adopt pursuant to Article 3(3-bis) of Legislative Decree No. 216/2003 and Article 5 of Directive 2000/78/EC.
