Reddito di cittadinanza – sentenza della CGUE 7.5.2026 – titolari di protezione internazionale - incompatibilità del requisito di residenza decennale con gli artt. 26 e 29 direttiva 2011/95  – applicabilità dei principi ivi espressi anche al requisito come ridotto dalla sentenza Corte Cost. n. 31/2025 -  infondatezza della pretesa restitutoria dell’INPS – diritto del titolare di protezione al pagamento dei ratei residui fino al completamento dei 18 mesi – sussistenza

In tema di requisiti di residenza pregressa per l’accesso al RDC la sentenza CGUE del 7.5.2026 C- 747/22, pur essendo riferita al requisito decennale originariamente previsto dal DL 4/2019 e non a quello quinquennale risultante dalla sentenza Corte Cost. n. 31/2025, esprime i principi applicabili anche al requisito minore, in particolare laddove afferma che, per quanto riguarda i titolari di protezione internazionale, qualsiasi requisito di pregressa residenza deve ritenersi in contrasto con gli artt. 26 e 29 della direttiva 2011/95/UE. Conseguentemente deve essere confermata la sentenza di primo grado che, già prima della sentenza della CGUE, aveva accertato l’inesistenza di un credito dell’INPS per restituzione di somme pagate a titolo di RDC al titolare di protezione con residenza infraquinquennale oltre a disporre la condanna dell’INPS a pagare le quote residue di RDC fino al completamente del periodo di 18 mesi.

On the question of prior residence requirements for access to the Citizens\' Income (Reddito di Cittadinanza), the CJEU judgment of 7 May 2026 in Case C-747/22 — although concerning the ten-year requirement originally laid down by Decree-Law No. 4/2019 and not the five-year requirement resulting from Constitutional Court judgment No. 31/2025 — sets out principles that are equally applicable to the lesser requirement; in particular, the Court holds that, as regards holders of international protection, any prior residence requirement, even one of shorter duration, must be regarded as incompatible with Articles 26 and 29 of Directive 2011/95/EU. Consequently, the first-instance judgment must be upheld: that judgment had already — prior to the CJEU ruling — found that INPS had no enforceable claim for restitution of sums paid by way of Citizens\' Income to a holder of international protection with a residence period of less than five years, and had ordered INPS to pay the outstanding instalments of Citizens\' Income until completion of the 18-month entitlement period.
